RULES OF THE PROMOTIONAL ACTION

"Swim to Travel with Unity Line and get a t-shirt! edition 2023"

§1 GENERAL PROVISIONS

  1. This document is referred to below as the "Terms".
  2. The promotional campaign conducted on the basis of the provisions of these   Regulations ["Promotional Campaign"] is aimed at advertising the activities and services of the Organizer and promoting the services provided by the Organizer for Participants and is organized under a title: "Swim to Travel with Unity Line and get a t-shirt! Edition 2023".
  3. The Organizer of the Promotional Campaign is: Unity Line Limited with its registered office in Limassol (Cyprus), operating through its branch: Unity Line Limited Sp. z o. o. Branch in Poland, Plac Rodła No. 8, 70-419 Szczecin, entered into the Register of Entrepreneurs kept by the District Court Szczecin - Centrum in Szczecin, 13th Commercial Division of the National Court Register under KRS number 0000487684, NIP: 3020001748, REGON: 321457024 ["Organizer" ].
  4. The Promotional Campaign will take place from June 21, 2023 to September 30, 2023 or until all the Prizes provided for Participants by the Organizer in the organized Promotional Campaign are issued

§2 RULES OF PARTICIPATION IN THE PROMOTIONAL ACTION

  1. Participants in the Promotion Campaign (hereinafter: "Participant") may be drivers of both delivery vehicles below 3.5 tons and drivers of trucks with a weight above 3.5 tons constituting cargo transported by sea on one of the ferries managed by the Organizer on the basis of tickets issued at ticket offices of the Organiser's cargo tickets (hereinafter: "Transport") in the period indicated in point 1 subpoint 1.4.
  2. Participants of the Promotional Campaign cannot be:
    • drivers who are operators of semi-trailers towed to and picked up from ports (i.e. non-ferry drivers where the transport unit is only a semi-trailer unaccompanied by a driver),
    • employees of the Organizer, persons remaining in a civil law relationship with the Organizer, or a family member or a close person of the Organizer's employee (the employee's family is understood as ascendants, descendants, spouse and siblings) and persons providing any services on ferries managed by the Organiser, regardless of their relationship civil law from which the benefit of these persons results.
  3. The condition for participation in the Promotional Campaign is to collect from the Organiser's cargo counter at one of the ferry terminals: in Świnoujście or Ystad (Sweden) or Trelleborg (Sweden) a carnet intended for the Participant to obtain Transport confirmations from representatives of the Organizer (hereinafter: "Caner") and to duly fill out the taken carnet.
  4. By taking the Carnet, the Participant accepts the provisions of these Regulations without reservations.
  5. Carnts are personal use only, they cannot be sold by Participants or transferred between Participants. The carnet without the name and surname of the Participant and the date of birth of the Participant is invalid.
  6. The confirmation of the Carriage as part of the Promotional Campaign is only the application by an authorized representative of the Organizer to the appropriate field of the Carnet with a stamp with a pattern developed by the Organiser.
  7. Confirmations of the Carriage will be made only simultaneously with the receipt of the Carnet for the Carriage, at the cargo counters indicated in point 2.3 above. In the event of a breach of the provisions of point 2.5 or in the event of damage to the Carnet to the extent that it is impossible to determine the Participant's data or the authenticity of the Carnet, the representatives of the Organizer have the right to refuse to confirm the Carriage.
  8. In the event of discrepancies between the Participant's data entered on the Carnet and the data resulting from the content of the ticket for the Carriage, the Organizer's representatives have the right to refuse to confirm the Carriage.
  9. In the case of loss or destruction of the Carnet, a duplicate of the lost or destroyed Carnet shall not be issued. In the cases described in the preceding sentence, the Organizer will not re-confirm the Transports performed in the previous period.
  10. The carnet is the property of the Organizer.
  11. If the Organizer's representatives find that the Carnet has been tampered with or the Transport confirmation has been falsified, the Organizer has the right, at its sole discretion, to retain such Carnet or Carnet containing a falsified Transport confirmation and to exclude the person whose name is on such Carnet from further participation in the Promotion Campaign.
  12. The Participant may take part in the Promotion Campaign only once and receive only one Prize within the meaning of point 3 of these Regulations.

§3 PRIZES

  1. Subject to other provisions of the Regulations, during the Promotional Campaign, after obtaining the appropriate number of Transportation confirmations on the original Carnet and meeting the conditions specified in point 3.8 and other requirements resulting from these Regulations, the Organizer will transfer to the Participant the ownership of the movable item indicated in point 3.3, issued in the order in which Participants meet the conditions set out in these Regulations. In the content of this document, the movable item indicated in point 3.3 below is also referred to as the "Prize".
  2. The value of Prizes or other benefits received by each participant of the Promotional Campaign may not exceed PLN 200.00.
  3. A T-shirt is understood as a Prize. The total number of Prizes provided for in the Promotional Campaign is 500 pieces.
  4. The Participant's right to collect the Prize cannot be transferred to a third party.
  5. The Participant has no right to demand the exchange of the Prize to which he is entitled to another Prize or another item of the same type as the Prize or to demand from the Organizer payment of the cash equivalent of the Prize or any other benefit.
  6. During the Promotional Campaign, the Organizer has the right to change to other items constituting the Prizes or to change the number of Prizes intended for the Participants of the Promotional Campaign.
  7. The Organizer reserves the right to refuse to issue the Prize to the Participant in any of the following cases:
    • exhaustion of the number of Prizes provided by the Organizer for Participants of the Promotional Campaign;
    • the end of the period of the Promotional Campaign;
    • the Participant's failure to consent to the processing of his personal data or other data referred to in point 3.8.2 or point 3.8.3 or withdrawal or limitation of previously expressed consent;
    • stating that the Participant has already received the Prize as part of the Promotional Campaign;
    • a violation of the provisions of the Regulations by the Participant;
  8. The conditions for issuing the Prize to the Participant are:
    • issuing to the representative of the Organizer by the Participant whose data are permanently disclosed in the content of the Carnet, in the place indicated in point 3.9, before the expiry of the date indicated in point 1 point 1.4, the original fully completed Carnet meeting all the requirements of the Regulations, bearing the appropriate number of confirmations of the Transports made in the manner indicated in these Regulations;
    • prior to issuing the Prize by the Participant who is applying for the Prize and whose data is permanently disclosed in the content of the Carnet, in writing consent to the processing of personal data for purposes related to the Promotion Campaign;
    • prior to issuing the Prize, the Participant who is applying for the Prize and whose data is disclosed in a permanent manner in the content of the Carnet, provides information indicated by the Organizer or required by law;
    • prior to issuing the Prize, the Participant who is applying for the Prize and whose data is permanently disclosed in the content of the Carnet meets other requirements resulting from the content of these Regulations.
  9. The Prizes will be issued at the Organizer's  (cargo section) office in:
    • Świnoujściu at ul. Fińskiej nr 7
    • Ystad Bornholmsgatan 8C;
    • Trelleborg Norra Nyhamnsgatan 1C
      after the Participant presents an identity card and confirms the compliance of the Participant's personal data with the content of the data permanently disclosed in the content of the Carnet.
  1. The Organizer bears no liability towards the Participants, including for the actions or omissions of other persons whom the Organizer uses to organize the Promotional Campaign, and in particular for non-performance or incorrect performance of obligations under the Regulations. The Organizer is also not liable for any defects in the Prizes.

§4 EXEMPTION FROM TAX

The Organizer informs that in the event of collecting the Prize, the Participant should be exempt from personal income tax pursuant to Art. 21 section 1 point 68a of the Act of July 26, 1991 on personal income tax.

§5 PERSONAL DATA

  1. The administrator of the Participants' personal data collected in connection with the Promotional Campaign is the Organizer ["Personal Data"].
  2. The Organizer processes Personal Data in accordance with Regulation /EU/ 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ( EU Official Journal L2016, No. 119, p.1). ["GDPR"].
  3. the Data Protection Officer appointed by the Personal Data Administrator is available at pl. Rodła 8, 70-419 Szczecin, e-mail: iod@unityline.pl.
  4. Participants' personal data will be processed by the Organizer only for the purpose of implementing the Promotional Campaign (in particular for the correct determination of the right to the Prizes and issuing the Prizes), pursuant to art. 6 sec. 1 paragraph a. of the GDPR.
  5. Personal data will be stored by the Organizer for the period necessary to carry out the Promotional Campaign and transfer the Prizes and the complaint period referred to in point 6 sub-point 6.3. and then for the period necessary to fulfill the obligations imposed by the Organizer under generally applicable law, after which the personal data will be permanently deleted.
  6. The Organizer will not transfer the Data to a third country or international organizations.
  7. Personal data will not be used to make decisions based solely on the automated processing of Personal Data, including profiling, and those which produces legal effects on the Participant or similarly significantly affects the Participant.
  8. The Participant's rights related to the processing of Personal Data by the Organizer are contained in Chapter III of the GDPR. At any time, the Participant is entitled to request: (i) access to Personal Data, (ii) rectification of Personal Data, (iii) removal or limitation of Personal Data processing, (iv) objection to the processing of Personal Data (in particular by sending an e-mail e-mail to: iod@unityline.pl (v) transfer of Personal Data and (vi) lodging a complaint to the President of the Office for Personal Data Protection.
  9. The Organizer informs that providing Participants' personal data is voluntary, although it is a condition for receiving the Prizes and that the Participant has the right to access and correct their personal data at any time.
  10. the information contained in this paragraph is subject to change. In such a case, the Organizer will inform the Participant about their change, however, such a change of information will not constitute a change to the Competition and does not require the Participant's approval.

§6 FINAL PROVISIONS

  1. These Regulations are the only document defining the rules of the Promotional Campaign.
  2. The Regulations are available in the document version on the Organizer's website at: www.unityline.pl. The version of the Regulations posted there is the only current and binding version for the Organizer.
  3. Any doubts regarding the rules of the Promotional Campaign, interpretation and provisions of these Regulations shall be resolved by the Organizer
  4. Complaints of Participants regarding the Promotional Campaign or Prizes will be accepted only until September 30, 2023. The condition for a successful submission of a complaint by a Participant is its preparation in writing and submission in person or delivery via a common postal operator to the following address: Unity Line Limited Sp. z o. o. Branch in Poland, Plac Rodła No. 8, 70-419 Szczecin. Complaints in the matters indicated in the preceding sentence may also be sent to the e-mail address: karnet@unityline.pl, provided that they are delivered within 7 (seven) days from the date of sending the appropriate message by e-mail to the following address: Unity Line Limited Sp. z o. o. Branch in Poland, Plac Rodła No. 8, 70-419 Szczecin, signed by the Participant with a printout of the sent message.
  5. On keeping the deadline described in point 6.3. above, the date of submitting the complaint is decisive.
  6. The Participant lodging a complaint is obliged to indicate the address details of the person lodging the complaint, in particular those enabling to respond to the complaint, and to provide a concise description of the subject of the complaint and allegations.
  7. Correctly filed complaints of the Participants will be considered within 30 (thirty) business days from the date of delivery to the address indicated in point 6.3 above of the Participant's letter containing the complaint or a printout of the e-mail containing the complaint signed by the Participant.
  8. Any disputes related to the content of these Regulations, its interpretation, the Promotional Campaign, Prizes, the rights of Participants or other issues arising from the Promotional Campaign will be resolved by the Organizer. All decisions in this regard will be binding and final.
  9. The Organizer is entitled to change the provisions of the Regulations at any time, in particular in terms of dates or Prizes. The amended Regulations will come into force upon posting the content of the changes or a new version of the Regulations on the Organizer's website at the address: www.unityline.pl.
  10. The Organizer is entitled to cancel or terminate the Promotional Campaign at any time without giving any reason. The Organiser's decision regarding the issues indicated in the preceding sentence shall enter into force upon its publication on the website with the address: www.unityline.pl.
  11. the Organizer establishes the following e-mail address for all correspondence related to the Promotion Campaign: karnet@unityline.pl. Correspondence may also be sent via traditional mail to the address of Unity Line Limited Branch in Szczecin, pl. Rodła 8, 70-419 Szczecin.
